Child Labor Law restrictions on Construction
Sites
Fair Labor Standards Act ("FLSA")
regulates the employment of children under 18 years of age
in certain types of employment. For children aged 14 and 15,
some regulations apply. For children 16 to 18, other regulations
apply, and for children over 18, most regulations do not apply.
Generally, children aged 15 and under may not be employed
in a number of occupations, including construction. 29 CFR
§§ 570.33, 570.119.
Children aged 16 and 17 may work in construction
related operations, but may not be involved in certain "particularly
hazardous" occupations at a construction site. Those
occupations include:
- motor vehicle driver;
- operation of power-driven woodworking
equipment;
- operation of power-driven hoisting apparatus;
- operation of circular saws, bandsaws,
and guillotine shears;
- wrecking or demolition operations; and
- excavation operations.
All other activities may be engaged in.
