Employment and labor law

Our employment and labor law practice includes the representation of employers and employees in the following areas:

  • litigation of all forms of discrimination, wrongful discharge, breach of contract, denial of benefits and intentional tort claims;
  • practice before all federal, state and local administrative agencies, including the NLRB, OSHA, EEOC, DOL, OFCCP, and Ohio Civil Rights Commission;
  • defense of NLRB unfair labor practice charges, including those emanating from union salting campaigns;
  • negotiation and administration of collective bargaining agreements;
  • counsel regarding employment rights, compliance obligations and preventative measures;
  • defending pattern and practice charges alleging systemic discrimination;
  • arbitration of disputes arising out of collective bargaining agreements; and
  • prepare, review and defend affirmative action plans.

The Firm's attorneys are active in the Labor and Employment Law Sections of the American Bar Association, the Ohio State Bar Association, and the Cleveland and Akron Bar Associations. We are members of the Industrial Relations Research Association, and the National Employment Lawyers Association, and the American Bar Association.

Construction law

Our construction practice includes representation of owners, general contractors and subcontractors in the following areas:

  • contract document drafting;
  • contract negotiation;
  • assistance during project with contract compliance and scope of work issues;
  • assistance in determining construction claims and disputes;
  • litigation of construction disputes in court;
  • arbitration of construction disputes;
  • assistance with competitive bidding disputes;
  • prevailing wage issues; and
  • mechanics liens.

We have successfully represented clients in both public and private disputes involving every facet of construction law. Individual employee rights

Our individual employee practice includes the representation of employees in the following areas:

  • litigation of discrimination (age, gender, race, religion, creed, national origin, disability), sexual harassment, wrongful discharge, breach of contract, denial of benefits and intentional tort claims;
  • negotiation of executive employment agreements and severance packages.
  • counsel regarding employment rights and obligations;
  • review of employer mandated corrective action plans; and
  • equal pay, overtime and employee compensation issues.

Alternative dispute resolution

We offer a number of ADR services, including:

  • drafting ADR procedures for arbitration of employment, labor, commercial and construction disputes;
  • representing clients in mediation, a non-binding process designed to resolve disputes short of litigation or arbitration;
  • arbitration representation in employment, labor, commercial and construction disputes;
  • service as a neutral to resolve disputes.

As advocates, we have represented clients in ADR proceedings, both by court order and by agreement.

As a neutral, Mike Fortney is a member of the ADR Federal Court Panel for the Northern District of Ohio and is a member of the panel of arbitrators for the American Arbitration Association. Mike has served as an arbitrator on several cases.
